TERMS AND CONDITIONS OF ENTRY

  1. Information on How to Enter and prizes form part of these Terms and Conditions of Entry. Participation in this promotion is deemed acceptance of these Terms and Conditions of Entry.
  2. Entry is only open to Australian residents aged 18 years or over. By entering this promotion you are certifying that you are over 18 years of age. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter.
  3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  4. Incomplete, indecipherable or illegible entries will be deemed invalid.
  5. Multiple entries permitted, subject to the following:
    1. only one entry permitted per specified purchase requirement; and
    2. each entry must be submitted separately and in accordance with entry requirements;
    3. unrecognised barcodes will be deemed invalid and
    4. entry is restricted to five (5) entries per person per day within the ACT.
  6. The Promoter promotes/encourages consumers to enjoy responsible drinking. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Alcohol Guidelines. A full version of the guidelines is available at www.nhmrc.gov.au/publications.
  7. Entrants must retain their original purchase receipt to confirm proof of purchase. The original purchase receipt must be provided on the Promoter's request in order to claim the prize. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant's entries and forfeiture of any right to a prize.
  8. Online entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.
  9. Promotion commences at 12.01am EDT on 1 November 2009 and closes at 11.59pm EDT on 31 December 2009. The draw will take place at 12 noon EDT on Thursday 14 January 2010 at Primefocus, 104/55 Beach Street, Port Melbourne, VIC 3207. Winners will be notified by phone and mail. Subject to validation of the winning entry the Promoter or its agent will request confirmation of the winner's address details so that the prize may be awarded. The name of the winner will be published in The Australian on Thursday 28 January 2010. The Promoter's decision is final and no correspondence will be entered into.
  10. The first valid entry drawn will win a Melbourne Shopping Spree for four people (all aged at least 18 years of age) valued at up to $10,000 AUD (depending upon departure point). The prize includes $6,000 AUD spending money, one half day with a Grazia fashion stylist, return economy airfares from the winner's nearest state capital to Melbourne, three nights accommodation (twin share) in a five star hotel (buffet breakfast included) and return limousine transfers between Melbourne airport and the hotel. All travel related sales taxes and services are included. The prize, or any unused portion of the prize which is not used within the specified period, is not transferable or exchangeable and cannot be taken as cash unless specified otherwise.
  11. Any additional costs not specified in these Terms and Conditions including without limitation, additional meals, travel insurance and additional travel and transfers, will be the sole cost and responsibility of the prize winner and their companions. The prize must be taken by 31 December 2010 (trip is subject to booking and flight availability). The prize cannot be taken during Major Blackout periods. Major Blackout periods include all school holidays, public holidays, Melbourne Cup week, Christmas and Easter. The winner (and any companions) must depart from and return to the same departure point and travel together. The itinerary is to be determined by the Promoter in agreement with the winner, but in the event that an agreement cannot be reached, the Promoter reserves the right to determine the itinerary. Frequent flyer points will not form part of the prize. The prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present credit card at time of accommodation check in.
  12. The promoter strongly recommends Travel Insurance for the entire duration of the trip to protect against any additional cost that maybe incurred, in the event of unforseen circumstances. The cost of such insurance will be at the winner's cost.
  13. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  14. A draw for any unclaimed prize may take place on Monday 19 April 2010 at 12 noon EST at the same place as the original draw, subject to any directions from a regulatory authority. Results will be published in The Australian on Thursday 29 April 2010.
  15. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to
    1. disqualify any entrant; and/or
    2. subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  16. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
  17. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or death; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following:
    1. any technical difficulties or equipment malfunction (whether or not under the Promoter's control);
    2. any theft, unauthorised access or third party interference;
    3. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
    4. any variation in prize value to that stated in these Conditions of Entry;
    5. Any tax liability incurred by a winner or entrant; and/or
    6. Use of a prize.
  18. It is a condition of entry that the winner (and any companion) maybe required to execute a Deed of Acknowledgement, Release and Indemnity in a form prescribed by the Promoter in its discretion.
  19. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and Australian regulatory authorities. The winner's name maybe published as required under the relevant lottery legislation. Entry is conditional on providing this information. Unless otherwise advised, the Promoter may, subject to legislative requirements, also use the information for promotional, marketing and publicity purposes including sending electronic messages, without any further reference, payment or other compensation to the entrant. Entrants should direct any request to access, update or correct information to the Promoter at their address detailed below or by e-mail to privacy@mcwilliams.com.au.   20. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
